1. Acceptance of Terms

By accessing the CommunityHighlights website at communityhighlights.com ("Site") or subscribing to our email newsletter ("Service"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and CommunityHighlights Inc. ("Company," "we," "us," or "our").

2. Description of Service

CommunityHighlights is a content curation and newsletter service that:

  • Monitors publicly available posts in online communities and social networks.
  • Selects and summarizes the most-engaged content based on engagement metrics (reactions, comments, shares).
  • Delivers a weekly email digest to subscribers every Monday.
  • Operates a public-facing "Trending Hub" website displaying curated post cards linking to original sources.

We are a curation service, not a content host. All featured posts remain the property of their original creators and are linked, not reproduced.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice to subscribers.

3. Eligibility

To use CommunityHighlights you must be:

  • At least 13 years of age (or the minimum age of digital consent in your country, if higher).
  • Legally capable of entering into binding contracts.
  • Not prohibited from using the Service under applicable laws.

By subscribing, you represent and warrant that you meet these eligibility requirements.

4. Subscription and Account

4.1 Free Service

The CommunityHighlights email digest is provided free of charge. We reserve the right to introduce optional paid features in the future, which will be subject to separate terms and require explicit opt-in.

4.2 Subscription Process

By submitting your email address through our subscription form, you consent to receiving the weekly digest and any transactional emails (confirmation, unsubscribe acknowledgments). We use a confirmed opt-in process to protect against unauthorized subscriptions.

4.3 Unsubscribing

You may unsubscribe at any time by clicking the "Unsubscribe" link in any email or by contacting us at hello@communityhighlights.com. We process unsubscribe requests within 10 business days (usually immediately). You will not receive any further marketing emails after that.

5. Content and Curation

5.1 Third-Party Content

The posts featured in our digest and on our website are created by third parties and published on external platforms (Facebook, LinkedIn, Reddit, X, etc.). We do not claim ownership of any featured content.

5.2 Fair Use and Curation

Our curation practice is designed to fall within fair use principles. We feature brief descriptions, engagement summaries, and links to original content — not full reproductions. If you are the creator of featured content and wish to be removed, contact us at content@communityhighlights.com and we will remove it within 5 business days.

5.3 Accuracy

We strive to curate content accurately and responsibly but do not warrant the accuracy, completeness, or reliability of any featured third-party content. Opinions expressed in featured posts are those of the original authors.

6. Intellectual Property

The CommunityHighlights name, logo, website design, email template design, curation methodology, and all original written content we produce (introductory text, post descriptions, newsletter copy) are owned by CommunityHighlights Inc. and protected by copyright law.

You may not reproduce, distribute, or create derivative works from our original content without written permission. Sharing our newsletter with friends is encouraged and permitted.

7. Third-Party Links and Platforms

Our Service contains links to third-party websites and social media platforms. These links are provided for convenience. We:

  • Do not control or endorse third-party websites.
  • Are not responsible for the content, privacy practices, or terms of any third-party site.
  • Are not responsible for the accuracy of any linked post or the conduct of any community member.

Visiting linked third-party sites is at your own risk and subject to their respective terms of service.

8. Prohibited Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Submit false or misleading information when subscribing.
  • Attempt to reverse-engineer, scrape, or systematically download our curated content for commercial purposes.
  • Use our platform to harass, defame, or target any individual or group.
  • Impersonate CommunityHighlights or its team members.
  • Interfere with the security or integrity of our website or email infrastructure.

Violations may result in immediate termination of your subscription and, where applicable, referral to law enforcement.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, or error-free.
  • Any featured content is accurate, complete, or current.
  • The Service will meet your specific requirements.

Some jurisdictions do not allow disclaimer of implied warranties. If such laws apply to you, some of the above may not apply.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMMUNITYHIGHLIGHTS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed USD $100 or the amount you paid to us in the preceding 12 months, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless CommunityHighlights Inc. and its affiliates from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

Either party may terminate this agreement at any time:

  • You may terminate by unsubscribing from our emails.
  • We may terminate or suspend your access if you violate these Terms, without prior notice.

Upon termination, your right to use the Service ceases. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with proceedings conducted in San Francisco, CA. You waive the right to participate in class action lawsuits.

Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

14. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to subscribers via email at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

We will maintain an archive of prior versions upon request.
